This document must be updated each time it is revised. All revisions require written approval by an authorised representative of Essential Services Guide Pty Ltd.
Plain English Summary — What This Document Means For You
- If you are a Tenant (a business using Archer): You are signing up to a CRM platform owned by Essential Services Guide Pty Ltd and operated by Custos Group Pty Ltd. You pay a subscription, your data is isolated from other businesses, and you are responsible for how you use client data within your workspace.
- If you are a Team Member: Your Tenant Admin has added you to their workspace. You can only access what they give you permission to access.
- If you are a Client Portal User (a client of a business using Archer): The business you deal with has given you access to a portal so you can view your information. Your main relationship is with that business — not with Archer. Archer provides the technology only.
- Everyone: You must be 18 or over. You must keep your login details secure. You must not misuse the platform.
- Free trial: New Tenants get 3 months free — no credit card needed. After that, billing starts automatically.

Please Read Carefully Before Proceeding
These Terms and Conditions ("Agreement") constitute a legally binding contract between you and Custos Group Pty Ltd ABN 66 667 179 339 ("we," "us," or "our"), the operator of the Archer platform. Archer is owned and developed by Essential Services Guide Pty Ltd ABN 54 629 234 760. By creating an account, signing in, or using the Archer platform in any capacity, you agree to be bound by this Agreement. If you do not agree, you must not access or use the platform.
This Agreement applies to all user roles on the Archer platform, including Global Administrators, Tenant Administrators, Team Administrators, Team Members, and Client Portal Users. Certain provisions apply specifically to Client Portal Users and are clearly identified as such.
1. Definitions
The following terms have the meanings set out below throughout this Agreement:
"Archer" means the Archer platform, owned and developed by Essential Services Guide Pty Ltd ABN 54 629 234 760 and operated by Custos Group Pty Ltd ABN 66 667 179 339. References to "we," "us," or "our" in this Agreement refer to Custos Group Pty Ltd as the contracting and operating entity, except where the context expressly refers to Essential Services Guide Pty Ltd as the intellectual property owner.
"Platform" means the Archer software application and all associated services, features, APIs, mobile and desktop applications, Tenant portals, and Client Portal developed by Essential Services Guide Pty Ltd and made available by Custos Group Pty Ltd across all supported platforms including web, iOS, and Android.
"Client Portal" means the dedicated application and web portal through which Client Portal Users access features and information made available to them by their Tenant. The Client Portal is a distinct interface from the main Tenant workspace, accessible via its own sign-up and login flow.
"Global Admin" means an Archer-appointed administrator with the highest level of access who manages all tenants, system-wide configurations, and platform governance.
"Tenant" means a business entity or individual who has registered for a separate, isolated account on the Platform and has been assigned a unique business workspace.
"Tenant Admin" means the designated administrator appointed by a Tenant to manage their business workspace, users, settings, and billing.
"Team Admin" means a user within a Tenant's workspace who is authorised to manage specific team members and their access levels.
"Team Member" means an individual user added by a Tenant Admin or Team Admin to operate within a Tenant's workspace.
"Client Portal User" means a client of a Tenant who has been invited and granted limited, controlled access to the Client Portal by the Tenant. A Client Portal User's primary commercial relationship is with the Tenant, not with Archer.
"Account" means the registered user profile created upon sign-up by any of the user roles described above.
"Content" means any data, text, files, information, or other materials uploaded, submitted, or transmitted through the Platform.
"Subscription" means the applicable paid or free plan under which a Tenant accesses the Platform.
"Tenant Content" means any data or information a Tenant or its Team Members loads, creates, or manages within their workspace, including information about their clients.
"Free Trial" means the initial three (3) month period during which a new Tenant may access the Platform at no charge, as described in Section 8.
"App Stores" means the Apple App Store, Google Play Store, and any other third-party distribution platform through which the Archer application is made available.
2. Acceptance of Terms
2.1 By registering for an Account, clicking the acceptance checkbox during sign-up, or by accessing or using the Platform, you confirm that:
- You have read, understood, and agree to be bound by this Agreement;
- You have the legal capacity and authority to enter into this Agreement;
- If registering on behalf of a business entity, you have the authority to bind that entity to this Agreement; and
- You are at least 18 years of age, or the age of majority in your jurisdiction.
2.2 Tenant Admins are responsible for ensuring that all Team Members and Client Portal Users added to their workspace are made aware of and comply with these Terms.
2.3 Client Portal Users agree to these Terms when they register via the Client Portal sign-up flow. By accepting, Client Portal Users acknowledge that Archer provides the technology platform only, and that their primary service relationship is with the Tenant who invited them.
2.4 Continued use of the Platform following any amendments to this Agreement constitutes acceptance of the updated terms.
3. Account Registration & Sign-Up
3.1 Tenant Registration
Each Tenant must register their own unique business account using the Tenant sign-up portal. The following information is required:
- Full legal business name or trading name;
- Business registration number and/or ABN (where applicable);
- Primary business email address and contact number;
- Business address;
- Designated Tenant Admin name and contact details; and
- Acceptance of this Agreement.
3.2 Client Portal User Registration
Client Portal Users access Archer through a dedicated Client Portal — a separate application and sign-up flow distinct from the main Tenant platform. Client Portal Users are invited by their Tenant and must register via the Client Portal sign-up page. Required information includes:
- Full legal name;
- Valid email address;
- Contact telephone number; and
- Acceptance of this Agreement.
Client Portal Users will only ever see and interact with features and information that their Tenant has explicitly enabled for them. They do not have access to the Tenant workspace, other clients' data, or any platform administration features.
3.3 Account Security
You are responsible for maintaining the confidentiality of your login credentials. You agree to:
- Create a strong, unique password and update it regularly;
- Not share your credentials with any other person;
- Immediately notify Archer or your Tenant Admin of any unauthorised access; and
- Log out of your Account after each session on shared devices.
Archer will not be liable for any loss or damage resulting from your failure to comply with these security obligations.
3.4 Accurate Information
You agree to provide accurate, current, and complete information during registration and to update it promptly if it changes. Archer reserves the right to suspend or terminate any Account where information is found to be inaccurate, false, or misleading.
4. User Roles, Permissions & Responsibilities
4.1 Global Admin
The Global Admin is appointed solely by Archer and is responsible for:
- Managing all Tenant accounts and their configurations;
- Monitoring platform-wide usage, compliance, and security;
- Suspending or terminating Tenant or user accounts in breach of this Agreement; and
- Implementing system-wide updates, policies, and configurations.
4.2 Tenant Admin
The Tenant Admin is the primary account holder for a Tenant business workspace and is responsible for:
- Managing Team Admins, Team Members, and Client Portal Users;
- Configuring the business workspace and Client Portal settings;
- Determining what information and features are made available to each Client Portal User;
- Ensuring all users within their workspace comply with this Agreement;
- Managing billing, subscription, and payment details; and
- Maintaining the security and integrity of their workspace.
4.3 Team Admin
A Team Admin is appointed by the Tenant Admin and is authorised to:
- Add, remove, and manage Team Members within their designated team;
- Configure team-level settings and permissions; and
- Monitor team activity and performance within the Platform.
4.4 Team Member
A Team Member may access the Platform in accordance with the permissions granted by the Tenant Admin or Team Admin. Team Members must not:
- Access data or features outside their assigned permissions;
- Share their login credentials with any other person; or
- Use the Platform for any purpose outside the scope of their employment or engagement.
4.5 Client Portal User
A Client Portal User accesses Archer exclusively through the Client Portal — a dedicated interface separate from the main Tenant platform. The Client Portal experience is fully configured and controlled by the Tenant. Client Portal Users may only:
- View records, documents, and information that the Tenant has explicitly made available to them;
- Submit requests, forms, or communications to their Tenant through permitted Client Portal channels;
- Update their own profile and contact details; and
- Access features and functions enabled by the Tenant within the Client Portal.
Client Portal Users must not attempt to access any area of the Platform beyond their authorised Client Portal permissions. Disputes or queries relating to services provided by a Tenant should be directed to the Tenant. Archer is not a party to the commercial relationship between a Tenant and their clients.
5. Client Portal — Scope, Experience & Limitations
5.1 The Client Portal is a technology platform provided by Archer to enable Tenants to share information and communicate with their clients. Archer does not control the content, accuracy, or completeness of any information a Tenant makes available to Client Portal Users.
5.2 Archer is not responsible for the quality, nature, or fulfilment of any services provided by a Tenant to their clients. All service-related matters are solely between the Tenant and the Client Portal User.
5.3 The availability, features, and layout of the Client Portal are determined entirely by the Tenant. Archer does not guarantee any specific features or functionality within any individual Tenant's Client Portal.
5.4 Client Portal Users acknowledge that:
- Their access to the Client Portal is dependent on the Tenant maintaining an active Subscription with Archer;
- If a Tenant's Subscription is suspended or terminated, the Client Portal User's access will also be suspended or terminated;
- Archer will endeavour to provide reasonable notice where possible, but is not liable for loss of access resulting from a Tenant's account status; and
- Concerns about loss of access to important information should be raised directly with the Tenant.
6. Tenant Data Obligations
6.1 Tenants may load, store, and manage any categories of data within their workspace that are necessary for their legitimate business purposes, including sensitive categories such as health information, financial details, or government identifiers.
6.2 By loading any data into the Platform, the Tenant warrants and represents that:
- They have a lawful basis under applicable privacy and data protection laws for collecting and processing that data;
- They have obtained all necessary consents from the individuals to whom the data relates;
- They have provided those individuals with appropriate privacy notices describing how their data will be used;
- The data does not infringe any third-party rights; and
- They will comply with all applicable laws in relation to the data they load, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
6.3 Archer is not responsible for, and expressly disclaims all liability in relation to, the data a Tenant loads into the Platform, including its accuracy, legality, or compliance with applicable laws.
6.4 Tenants must promptly notify Archer at helpdesk@teamarcher.com.au if they become aware of any unauthorised access to, or disclosure of, data held within their workspace.
7. Acceptable Use of the Platform
7.1 You agree to use the Platform only for lawful purposes and in accordance with this Agreement. You must not:
- Use the Platform for any fraudulent, unlawful, or unauthorised purpose;
- Upload or transmit any malicious code, viruses, or harmful content;
- Attempt to gain unauthorised access to any part of the Platform or to other users' data;
- Use the Platform to harass, threaten, or harm any person;
- Reproduce, duplicate, copy, sell, or exploit any portion of the Platform without our express written consent;
- Reverse engineer, decompile, or disassemble any part of the Platform;
- Use automated tools to scrape, mine, or extract data from the Platform; or
- Interfere with or disrupt the integrity or performance of the Platform or its servers.
7.2 Archer reserves the right to investigate and take appropriate legal and technical action against any user who violates this section, including suspension or termination of the offending Account.
8. Free Trial, Subscriptions & Billing
8.1 Free Trial
New Tenant accounts are eligible for a free trial period of three (3) months from the date of registration. During the free trial:
- No credit card or payment details are required to sign up;
- Full platform features are available, subject to any trial-specific limitations notified at sign-up;
- At the end of the three-month trial period, the Tenant Admin will be prompted to select a Subscription plan and provide payment details to continue accessing the Platform; and
- If no Subscription plan is selected at the end of the trial period, access to the Platform will be suspended until a plan is activated.
8.2 Subscriptions & Auto-Renewal
Once a Subscription plan is activated:
- Subscription fees are payable in advance on a monthly or annual basis, as selected by the Tenant Admin;
- Subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled by the Tenant Admin before the renewal date;
- The Tenant Admin will receive a renewal reminder notification prior to each renewal date; and
- By maintaining an active Subscription, the Tenant Admin authorises Archer to charge the applicable fees to the nominated payment method at each renewal.
8.3 Pricing Changes
Archer reserves the right to modify Subscription pricing with not less than 30 days' written notice to the Tenant Admin. Continued use of the Platform after the effective date of any price change constitutes acceptance of the new pricing.
8.4 Failed Payments & Grace Period
If a Subscription payment fails:
- Archer will notify the Tenant Admin by email and provide a grace period of seven (7) days to update payment details and complete the outstanding payment;
- If payment is not received within the seven (7) day grace period, access to the Platform — including for all Team Members and Client Portal Users within that Tenant's workspace — will be suspended; and
- Suspended accounts may be reactivated upon receipt of all outstanding amounts. Archer is not liable for any loss or inconvenience resulting from a suspension due to non-payment.
8.5 Cancellation & Refunds
Tenant Admins may cancel their Subscription at any time through the Platform's account management settings. Upon cancellation:
- Access to the Platform will continue until the end of the current paid billing period;
- No refunds will be issued for any unused portion of a prepaid Subscription period, except as required by the Australian Consumer Law; and
- Data retention provisions in Section 9.7 will apply from the end of the final billing period.
8.6 Client Portal Users & Billing
Client Portal Users do not pay Archer directly. Their access to the Client Portal is provided as part of the Tenant's Subscription. If a Tenant's Subscription lapses, Client Portal Users will lose access to the portal.
9. Data, Privacy & Multi-Tenancy
9.1 Data Isolation
Archer operates on a multi-tenant architecture. Each Tenant's workspace data is logically isolated from all other Tenants. Archer implements industry-standard technical and organisational measures to maintain this isolation.
9.2 Data Ownership
Each Tenant retains full ownership of all Content and data they upload or generate within their workspace. Archer does not claim ownership of Tenant Content.
9.3 Client Portal User Data — Controller & Processor
In respect of Client Portal User personal information held within a Tenant's workspace:
- The Tenant acts as the data controller — they determine the purpose and manner of processing;
- Archer acts as the data processor — processing that data on behalf of and under the instruction of the Tenant; and
- The Tenant bears full responsibility for compliance with applicable privacy laws in relation to their clients' data, consistent with Section 6 of this Agreement.
9.4 What Client Portal Users Can See
Client Portal Users can only access data and information within their own dedicated profile as configured by the Tenant. They cannot view other clients' data, Tenant workspace data, or administrative information.
9.5 Tenant Responsibility Disclaimer
Archer expressly disclaims all liability in connection with:
- The accuracy, completeness, or currency of any information a Tenant loads or shares through the Client Portal;
- Any representations made by a Tenant to their clients through the Client Portal;
- The Tenant's compliance with privacy laws in relation to their clients' personal data; and
- Any disputes between a Tenant and their clients arising from the use of the Client Portal.
9.6 Privacy Policy
By using the Platform, you acknowledge and agree to Archer's Privacy Policy, which is incorporated into and forms part of this Agreement.
9.7 Data Retention & Deletion
- Upon termination or expiry of a Tenant's Subscription, Archer will retain the Tenant's workspace data — including Client Portal User data — for 30 days, during which the Tenant may request a data export;
- After the 30-day retention period, all Tenant and associated Client Portal User data will be permanently deleted; and
- Archer may retain anonymised, aggregated data for analytical purposes.
10. Intellectual Property
10.1 The Platform, including all software, technology, designs, trademarks, logos, and content, is and remains the sole and exclusive intellectual property of Essential Services Guide Pty Ltd ABN 54 629 234 760 (the owner and developer of Archer). Custos Group Pty Ltd ABN 66 667 179 339 operates the Platform under licence from Essential Services Guide Pty Ltd.
10.2 This Agreement grants you a limited, non-exclusive, non-transferable, revocable licence to use the Platform solely in accordance with this Agreement. No ownership right, title, or interest in the Platform is transferred to you.
10.3 You must not use Archer's trademarks, logos, or branding without our prior written consent.
10.4 If you submit any feedback, suggestions, or ideas about the Platform, you grant Essential Services Guide Pty Ltd and Custos Group Pty Ltd a perpetual, irrevocable, worldwide, royalty-free licence to use, modify, and incorporate such feedback without obligation to you.
11. App Store Compliance
11.1 The Archer platform is available for download and use via third-party App Stores, including the Apple App Store and Google Play Store. Where you access Archer through an App Store, the following additional terms apply:
- This Agreement is between you and Archer only — not between you and the App Store provider (Apple Inc. or Google LLC);
- The App Store provider has no obligation to provide any maintenance or support in relation to the Archer application;
- In the event of any failure of the Archer application to conform to any applicable warranty, you may notify the relevant App Store provider and they may refund the purchase price (if any) in accordance with their terms — beyond this, the App Store provider has no warranty obligation in relation to the application;
- The App Store provider is not responsible for addressing any claims by you or any third party relating to the Archer application;
- You must comply with any applicable third-party terms when using the Archer application (e.g. your mobile data service agreement); and
- Apple Inc. and Google LLC are third-party beneficiaries of this Section 11 and may enforce it against you.
11.2 Archer reserves the right to update, modify, or discontinue the application available through any App Store at any time in accordance with the relevant App Store's policies.
12. API Access
12.1 Archer intends to make an application programming interface (API) available to Tenant Admins in a future release of the Platform. When the API becomes available, the following terms will apply:
- API access will be subject to additional API-specific terms and conditions published at that time;
- API access credentials (keys and tokens) are provided solely for the authorised Tenant's use and must not be shared with any third party;
- Tenants are responsible for all activity occurring under their API credentials;
- Archer reserves the right to impose rate limits, usage caps, and fair use policies on API access; and
- Any use of the API that places unreasonable load on the Platform infrastructure or compromises platform security may result in immediate suspension of API access.
12.2 Until the API is made generally available, this section serves as notice of Archer's intended API terms. Archer will notify Tenant Admins when API access becomes available.
13. Confidentiality
13.1 Each party may have access to information that is proprietary or confidential to the other party ("Confidential Information"). Each party agrees to:
- Keep all Confidential Information strictly confidential;
- Not disclose Confidential Information to any third party without prior written consent; and
- Use Confidential Information only for the purposes of this Agreement.
13.2 These obligations do not apply to information that is publicly available, independently developed, or required to be disclosed by law or court order.
14. Platform Availability & Maintenance
14.1 Archer endeavours to maintain the Platform in a reasonably available and functional state but does not guarantee any specific level of uptime or availability.
14.2 Archer will use reasonable endeavours to provide Tenant Admins with not less than 48 hours' prior notice of any planned maintenance or scheduled downtime, except where emergency maintenance is required to address a critical security or stability issue.
14.3 Archer is not liable for any loss or damage arising from Platform unavailability, whether scheduled or unscheduled.
15. Disclaimers & Limitation of Liability
15.1 THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ARCHER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
15.2 Archer does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
15.3 Archer is not liable for, and expressly excludes all liability in relation to, the actions, content, data, or conduct of any Tenant or Client Portal User on the Platform.
15.4 To the maximum extent permitted by applicable law including the Australian Consumer Law, Archer's total liability to you for any claim arising under or in connection with this Agreement shall not exceed the total Subscription fees paid in the 12 months immediately preceding the claim. Where you are a Client Portal User who does not pay Archer directly, Archer's liability to you is limited to the greatest extent permitted by law.
15.5 In no event shall Archer be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.
15.6 Nothing in this Agreement excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.
16. Term & Termination
16.1 This Agreement commences on the date you first access or use the Platform and continues until terminated.
16.2 Tenant Admins, Team Admins, and Team Members may terminate their Account at any time by submitting a written request to Archer or using the account closure function within the Platform.
16.3 Client Portal Users may request closure of their Client Portal account at any time by contacting their Tenant directly. Client Portal Users may also contact Archer at helpdesk@teamarcher.com.au.
16.4 Archer may suspend or terminate any Account, with or without notice, if:
- You breach any provision of this Agreement;
- The associated Tenant's Subscription fees are overdue beyond the grace period in Section 8.4;
- We reasonably suspect fraud, abuse, or illegal activity; or
- We are required to do so by law or a regulatory authority.
16.5 Upon termination, all licences granted under this Agreement cease immediately. Data retention provisions in Section 9.7 apply.
17. Governing Law & Dispute Resolution
17.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to conflict of law principles. The contracting entity for this Agreement is Custos Group Pty Ltd ABN 66 667 179 339.
17.2 Any dispute arising out of or in connection with this Agreement shall first be attempted to be resolved through good-faith negotiation between the parties.
17.3 If the dispute is not resolved through negotiation within 30 days, either party may refer the matter to mediation conducted in Victoria, and if still unresolved, to the courts of competent jurisdiction in Victoria, Australia.
17.4 Disputes between a Client Portal User and a Tenant are solely between those parties. Archer is not a party to such disputes and does not accept any obligation to mediate or resolve them.
18. Amendments to This Agreement
18.1 Archer reserves the right to amend this Agreement at any time. Users will be notified of material changes via email or an in-platform notification at least 14 days before changes take effect.
18.2 Tenant Admins are responsible for notifying their Team Members and Client Portal Users of any such changes.
18.3 Continued use of the Platform after the effective date of any amendment constitutes acceptance of the amended Agreement.
19. General Provisions
Entire Agreement: This Agreement, together with the Privacy Policy and any applicable Subscription terms, constitutes the entire agreement between the parties and supersedes all prior agreements relating to the Platform.
Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
No Waiver: Failure by either party to enforce any provision of this Agreement shall not constitute a waiver of that right in future.
Assignment: You may not assign your rights or obligations under this Agreement without Archer's prior written consent. Archer may assign this Agreement without restriction.
Force Majeure: Neither party shall be liable for failure or delay in performance due to causes beyond their reasonable control, including acts of God, cyberattacks, pandemic, or government actions.
Australian Consumer Law: Nothing in this Agreement is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

Sign-Up Acceptance Declaration
By completing the sign-up process and checking the boxes below, you confirm that you have read, understood, and agree to be bound by the Archer Terms and Conditions of Use.
- I have read and I agree to the Archer Terms and Conditions of Use.
- I confirm that I am at least 18 years of age (or the age of majority in my jurisdiction).
- I confirm that all information provided during registration is accurate and complete.
- (Tenant Admins only) I confirm that I have the authority to bind my business entity to this Agreement and that I will ensure all data I load into the Platform complies with applicable privacy laws.
- (Client Portal Users) I understand that my primary service relationship is with the Tenant who invited me, and that Archer provides the technology platform only.
- I have read and I agree to the Archer Privacy Policy.
